Our approach

We want you to understand what you are buying, what happens after purchase and how to raise a question. These terms do not reduce any rights that applicable consumer law gives you.

About these terms

These Terms & Conditions govern use of thewinningbrief.eu and purchases from The Winning Brief, including one-to-one communication coaching, team workshops, and the Command the Room digital course. They apply alongside the description and purchase terms shown for the particular service you order.

The Winning Brief provides communication training and educational resources for legal professionals. It does not provide legal representation or advice on the substantive law of a matter. You remain responsible for your own legal analysis, professional obligations, and decisions.

For organizations buying on behalf of staff, the purchaser is responsible for ensuring participants receive relevant attendance and access instructions. If an individually negotiated proposal or a clear product-specific agreement differs from these general terms, the specific agreed provision applies, subject to mandatory law.

Our services and learning products

One-to-one coaching

Individual coaching may be purchased as a paid 60-minute working session or as a 10-hour or 20-hour coaching package. The sessions are tailored to relevant professional communication situations, such as client calls, presentations, negotiations, written communication, and responding to difficult questions. Package hours and any individual delivery arrangements are confirmed through the product information and booking correspondence.

Team workshops

Workshops are normally scoped as two-hour communication training sessions for legal teams. The particular objective, online or in-person delivery, participant group, schedule, and any preparation requirements are confirmed in the proposal accepted by the organization.

Published standard workshop pricing includes up to eight participants. For groups of 9 to 12, an additional fee of €200 per participant applies. Groups of 13 or more require a tailored quotation. Published workshop fees exclude VAT and, for in-person delivery, travel expenses. The final proposal confirms the full amount and any applicable taxes and expenses.

Command the Room in 10 Days

Command the Room is a digital, independent-learning course for lawyers working professionally in English. Its published description includes 20 modules in a ten-day learning sequence, a 32-page workbook, and Personal Legal English Toolkit activities. The course page and checkout confirm the access start date, included materials, access duration, price, and other terms applicable when you enroll.

The separate coaching page, workshop page, and course page provide the current offer descriptions.

Orders, proposals and contract formation

When you purchase a coaching product online, you submit an order through the designated WooCommerce or Calendly checkout. You will be able to review the selected service and its price before confirming payment. An order confirmation or receipt will be sent using the details you provide. If a payment or booking is not accepted, we will contact you about the next step or applicable refund.

Command the Room enrollment is completed through the linked Thinkific checkout. Any Thinkific account creation, technical access, and platform-specific conditions are presented through that service. Your order confirmation and the applicable purchase information establish what you have bought.

A team workshop inquiry or discovery call is not itself a booking. Workshop engagements become binding once the proposal, including the agreed scope, fee, schedule and cancellation terms, has been accepted in the manner stated in that proposal.

Please ensure that the name, contact information, and any invoicing details you provide are accurate. If your employer or organization will pay, please arrange the appropriate approval before checkout or ask us about invoicing before placing the order.

Prices, VAT, payments and invoices

The applicable price is the price disclosed for the chosen service at the time of purchase or in an accepted workshop proposal. Payments are processed through the checkout provider indicated for the relevant product. We do not require you to give payment card details by ordinary email.

Workshop starting fees shown on the website are quoted excluding VAT and any specified in-person travel costs. Where a customer is purchasing as a consumer, the total price including applicable taxes and mandatory charges must be shown before the consumer places a binding paid order. A business quotation or invoice will identify VAT treatment and any additional agreed expenses.

For individually negotiated services, the proposal will specify payment timing, invoicing arrangements and any applicable expenses. We do not impose undisclosed fees after an order has been placed.

Booking and using coaching hours

A paid 60-minute session is booked through the designated Calendly booking route. For 10-hour and 20-hour packages, booking instructions are supplied after payment. These may include individual-use scheduling links or a mutually agreed booking process.

Purchased coaching hours are applied to the coaching time actually delivered. The agreed session length, delivery method, pace, availability, and any booking window or package expiry are communicated before the relevant commitment or recorded in the individual agreement. A coaching package does not guarantee that every requested date or time will be available.

If you need to reschedule or cannot attend, contact us as soon as possible. Any applicable notice period, missed-session charge, package expiry or extension rules must be communicated clearly before you purchase and cannot override mandatory consumer rights. If The Winning Brief must move or cancel a session, we will offer a reasonable alternative or address the undelivered service according to the contract and applicable law.

Team workshops and organizational bookings

Workshop delivery is based on an agreed objective, participant group, date and format. The purchaser should identify any accessibility needs, location requirements, or technical constraints during planning so these can be addressed in the proposal.

Where examples from a firm's legal work would support the training, they should be anonymized or adapted as appropriate. Do not send privileged, restricted, or confidential client information unless a secure, suitable arrangement has been agreed in advance.

The accepted workshop proposal should specify preparation, materials, travel, invoicing and payment milestones, and cancellation or postponement terms. Changes to attendee numbers, location or scope may require a revised fee or schedule, but only as agreed with the purchasing organization.

Digital course access and platform requirements

Command the Room is delivered via Thinkific or another platform identified at the time of enrollment. You are responsible for a suitable internet connection, compatible device, and access to the email account used for registration.

Course access begins at the time stated in your purchase confirmation or offer. If you buy before the announced course launch, the sales page and order confirmation will specify whether any content is available early and when the remainder becomes accessible. Access duration, including any advertised lifetime-access commitment, is governed by what was promised at purchase and applicable law.

We may make reasonable updates to course content or platform functionality, but will not remove material features or reduce any legally protected access rights without an appropriate remedy. If you experience an access problem, contact contact@thewinningbrief.eu.

Consumer right of withdrawal

If you purchase online as a consumer rather than primarily for professional or business purposes, European and Belgian distance-selling rules may give you a 14-day right of withdrawal, subject to statutory exceptions. The period generally begins on the day after the service contract is concluded. To exercise the right, send us a clear statement of your decision to withdraw before the deadline. You may use the model withdrawal form below, but you are not obliged to use it.

Coaching and other live services

If you expressly request that a paid service begin within the withdrawal period, and you then withdraw while the service is partly performed, you may owe a proportionate amount for the service already supplied, but only where the legal conditions are met. If a service has been fully delivered after your prior express request and the required acknowledgment, the statutory right of withdrawal may be lost. Merely booking a session or purchasing a package does not automatically remove your statutory rights.

Digital learning content

For digital content not supplied on a physical medium, the right of withdrawal may be lost once supply begins only if the required conditions are satisfied, including your prior express consent to start within the withdrawal period, your acknowledgment that this means losing the right, and appropriate confirmation from the seller. Access to a digital course does not, by itself, replace those consent and confirmation requirements. Some continuing digital services can be subject to different withdrawal rules.

Where a valid withdrawal is exercised, any refund due will be made according to the applicable legal requirements, normally using the original payment method unless otherwise agreed. These terms do not limit any mandatory rights relating to defective or nonconforming digital content or services.

Other cancellations, transfers and refunds

Outside any statutory withdrawal right, a cancellation or refund request is assessed against the specific policy clearly disclosed and agreed for the product or service at the time of purchase and any applicable law. No blanket “no refunds” rule applies by virtue of this page alone.

For coaching packages, please contact us about unused hours, a significant scheduling problem, or exceptional circumstances. For workshops, the accepted proposal governs postponement, cancellation costs, and any agreed nonrefundable preparation or travel expense, where lawful. For Command the Room, consult the purchase terms presented at Thinkific checkout and contact us if digital access or conformity is in question.

If a service cannot be provided as agreed, The Winning Brief will offer an appropriate solution, such as rescheduling, correcting an access issue, or a refund where required by the contract or law.

Confidentiality and professional responsibility

We take the professional context of legal work seriously. Please share only information necessary for a coaching or training exercise, and use anonymized or fictional scenarios wherever possible. Do not transmit privileged client documents, personal data about third parties, or other restricted material through unapproved website forms, booking tools, email attachments or public AI tools.

If a specific matter requires additional confidentiality measures, raise the requirement before providing the material so that suitable arrangements can be discussed. Each participant and purchasing organization remains responsible for its own professional secrecy, client confidentiality, information security and regulatory obligations.

Our coaching and training support communication effectiveness. It does not substitute for legal advice, professional supervision, or your independent legal judgment.

Course materials and intellectual property

Unless expressly stated otherwise, website copy, coaching frameworks, workbooks, exercises, course videos, recordings and other training materials are protected by intellectual property rights belonging to The Winning Brief or their respective licensors.

When you buy access, you receive a personal, limited, non-transferable right to use the included materials for your own learning or for the specifically agreed internal organizational training purposes. You may not resell, distribute, upload publicly, or reproduce the materials for an independent training business without permission, except where a statutory exception applies.

You retain ownership of the material that you create or lawfully supply for coaching. We do not obtain ownership of your client documents merely because you use them during a session.

Website, external services and changes

We make reasonable efforts to keep the website, booking links, and learning services available and accurate. Certain steps rely on independent providers, including WooCommerce payment services, Calendly, and Thinkific. Their separate terms may apply to the operation of their platforms, but do not displace consumer rights against the responsible seller.

We may update website content and these Terms & Conditions from time to time. Updated terms apply prospectively and do not unilaterally alter the core rights and obligations of purchases already concluded. If an existing contract needs an agreed change, we will communicate it appropriately.

Responsibility and legal rights

Training results depend on circumstances, preparation and practice. We do not guarantee a specific career, client, negotiation, financial or legal outcome from attending a session, workshop or course.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, willful misconduct, death or personal injury where applicable, or mandatory consumer remedies. Other rights and remedies remain subject to the agreed contract and Belgian and EU law.

Questions, complaints and dispute resolution

If something is not right, please contact contact@thewinningbrief.eu, including your order reference where relevant, and explain what outcome you are seeking. We will review the concern and try to resolve it fairly.

Consumers in Belgium may also seek information or assistance from the independent Belgian Consumer Mediation Service, where it is competent. This does not affect a consumer's right to take a dispute to a competent court. The former EU Online Dispute Resolution platform closed in July 2025 and is not used for new complaints.

These terms are interpreted under Belgian law, without depriving consumers of mandatory protections that apply in their country of residence. Any dispute about jurisdiction is subject to the mandatory rules applicable to the customer and the contract. For individually negotiated business contracts, any agreed dispute-resolution provision in the accepted proposal also applies to the extent permitted by law.

Privacy and contact

Our handling of personal information, including contact requests, bookings, course registrations, and marketing communications, is explained in our Privacy Policy. You can contact contact@thewinningbrief.eu for questions about how these terms apply to your order.
